This website is operated by Pilot Assessments BV. Throughout the site, the terms “we”, “us” and “our” refer to Pilot Assessments BV. We offer this website, including all information, tools and services made available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these terms and conditions (“Terms”). These Terms apply to all users of the site, including without limitation users who are browsers, customers, merchants and/or contributors of content. Please read these Terms carefully before using the site. If you do not agree to all the terms of this agreement, then you may not access the website or use any of its services.

Eligibility and account use

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses or any code of a destructive nature.

Account sharing is not permitted. The user who paid for the account is the only user permitted on that specific account. A breach or violation of any of the Terms will result in an immediate termination of your Services.

Forum and community content

Our forum lets members ask questions, share experiences and help fellow trainees. Posts, replies and other contributions on the forum are user-generated content and reflect the personal opinions and experiences of the individual members who wrote them.

Forum content does not constitute personal, professional, aviation, medical, legal, career or financial advice from us, and it is not reviewed, verified or endorsed by Pilot Assessments BV. We do not guarantee that any information posted on the forum is accurate, complete or current. Any reliance you place on forum content is strictly at your own risk, and you should always consult primary, more accurate and up-to-date sources before making any decision.

You are solely responsible for the content you post and for its accuracy. You agree that your contributions will not violate the rights of any third party — including copyright, trademark, privacy or personality rights — and will not contain defamatory, unlawful, abusive, obscene or otherwise objectionable material, nor any virus or malware. You may not impersonate any person or misrepresent the origin of a contribution.

We may, but have no obligation to, monitor, edit or remove content that we reasonably determine to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes any party’s intellectual property or these Terms. By posting content, you grant us a non-exclusive, royalty-free, worldwide licence to use, edit, copy, publish, translate and distribute that content in any medium. We take no responsibility and assume no liability for any content posted by you or any third party.

Accuracy of information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. We cannot guarantee in any way that practising on our platform has an effect on your potential assessment or interview. All practice material is carefully composed by us; no rights can be derived from it.

Payment, access and cancellation

You agree to pay all charges at the prices then in effect for your purchases, and you authorise us to charge your chosen payment provider. If your purchase is subject to recurring charges, you consent to us charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until you notify us of your cancellation.

On successful completion of your purchase you gain immediate access to the online course material. Because of this immediate access and delivery of our digital products, all sales are final: we do not offer refunds, exchanges or credit for digital products once a purchase has been made.

You may cancel your subscription at any time by logging into your account or by contacting us. Your cancellation takes effect immediately; however, you retain access to our courses for the remainder of the subscription period you have paid for. If you purchase a new membership while an existing membership is still active, any remaining days will not be added to the new membership, and we will not reimburse unused days.

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part or content of it) at any time without notice, and we will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Prohibited uses

You are prohibited from using the site or its content:

• for any unlawful purpose;
• to solicit others to perform or participate in any unlawful acts;
• to violate any international, federal, provincial or state regulations, rules, laws or local ordinances;
• to infringe upon or violate our intellectual property rights or those of others;

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that the results obtained from the use of the Service will be accurate or reliable. You expressly agree that your use of, or inability to use, the Service is at your sole risk. In no case shall Pilot Assessments BV, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind arising from your use of the Service or any content posted, transmitted or otherwise made available via the Service. Where liability cannot be excluded, it will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend and hold harmless Pilot Assessments BV and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees, from any claim or demand, including reasonable lawyers’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Your submission of personal information through the site is governed by our Privacy Policy.

These Terms and any separate agreements whereby we provide you Services are governed by and construed in accordance with the laws of the Netherlands.
